1. Interpretation and Definitions

1.1 Interpretation

Capitalized terms have the meanings provided in this Section or otherwise defined in these Terms. The definitions apply regardless of whether terms appear in singular or plural.

1.2 Definitions

• Affiliate means any entity that controls, is controlled by, or is under common control with the Company, where “control” means direct or indirect ownership of at least fifty percent (50%) of the equity interests or voting securities.
• Application means the web application titled “Vibe Dieting,” including all related features, tools, content, and updates, accessible at vibedieting.xyz.
• Company, We, Us, or Our means Vibe Dieting, reachable at vibedieting@lembo.email.
• Device means any device capable of accessing the Service, including computers, smartphones, and tablets.
• Service means, collectively, the Application, the Website, associated software, content, AI-powered tools, and any services offered by the Company.
• User Content means any images, photographs, text, food entries, descriptions, metadata, or other content uploaded, submitted, or transmitted by You through the Service.
• Website means vibedieting.xyz and any associated subdomains.
• You means the individual using the Service or the legal entity on whose behalf the individual uses the Service.

2. Agreement to Terms

Your access to and use of the Service is conditioned upon Your acceptance of these Terms and the Vibe Dieting Privacy Policy. By accessing or using the Service, You acknowledge that You have read, understood, and agreed to be bound by these Terms. If You do not agree, You must discontinue use of the Service.

3. Eligibility; Age Requirements

You represent and warrant that You are at least 13 years old.

If You are between 13 and 17 years old, You may only use the Service with the consent and supervision of a parent or legal guardian, who agrees to be fully responsible for all activities conducted using the Service.

4. Health, Nutrition, and Safety Disclaimers

Vibe Dieting does not provide medical advice, nutritional counseling, or professional health services. All calorie estimates, macro calculations, nutritional insights, and food identifications are automated approximations and may be incomplete or inaccurate.

• Calorie and macro estimates are approximations only and may not be accurate for all foods.
• The Service is not intended to diagnose, treat, cure, or prevent any disease or health condition.
• You should consult licensed medical or nutrition professionals for dietary or health guidance.
• The Company is not liable for inaccuracies in calorie counts, macro estimates, or food identification.
• AI-generated meal plans and nutrition coaching are for informational purposes only and do not constitute professional dietary advice.

5. User Content; License Grant

By submitting User Content, You represent that You own or have rights to it. You grant the Company a worldwide, irrevocable, royalty-free, transferable, sublicensable license to use, reproduce, analyze, process, modify, publish, and create derivative works from the User Content to operate and improve the Service, including improving AI analysis accuracy.

You agree not to upload unlawful, harmful, offensive, or infringing content.

6. Prohibited Uses

You agree not to:

• Upload violent, explicit, or unlawful content
• Reverse engineer, decompile, or perform competitive analysis of the Service
• Circumvent security protections or gain unauthorized access
• Upload images of individuals without lawful consent
• Interfere with the Service's operation, servers, or networks
• Use automated tools or scripts to access the Service at scale without permission
• Attempt to manipulate or abuse AI features to generate excessive API costs

7. Subscription, Billing, and Payments

Vibe Dieting may offer free and paid subscription tiers. Paid subscriptions are processed through Stripe, our payment processor. Stripe's terms govern payment processing.

Subscriptions automatically renew unless cancelled before the current period ends. We reserve the right to change pricing with reasonable advance notice. Refund eligibility is determined on a case-by-case basis. To request a refund or cancel your subscription, contact us at vibedieting@lembo.email.

8. Third-Party Services

The Service includes integrations with third-party services. The Company does not control and is not responsible for such services. These include:

• OpenAI — powers AI-based food analysis, meal planning, and coaching features
• Clerk — handles authentication and account management
• Supabase — provides database and data storage
• Withings — optional integration for weight and body composition data sync
• Strava — optional integration for activity and exercise data sync
• Vercel — provides hosting and infrastructure
• Stripe — processes payments for paid subscriptions

Your use of connected third-party services is subject to their respective terms of service and privacy policies.

9. Intellectual Property

All rights in the Service (excluding User Content) are owned exclusively by the Company or its licensors. You may not copy, modify, distribute, sell, or reverse engineer any part of the Service. You retain ownership of data you enter into Vibe Dieting (meal logs, food entries, weight data, etc.), subject to the license grant in Section 5.

10. Termination

The Company may suspend or terminate Your access at any time if You violate these Terms or engage in conduct harmful to the Service or other users. Upon termination, all rights granted to You immediately cease. You may delete your account at any time through the app settings or by contacting us.

11. “AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided without warranties of any kind, express or implied. The Company disclaims all warranties including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely accurate. AI-generated nutrition data, meal plans, and coaching responses are estimates and may not be accurate for every food, individual, or situation.

12. Limitation of Liability

To the maximum extent allowed by law, the Company's total liability shall not exceed the greater of:

• The amount You paid to the Company in the preceding 12 months, or
• One hundred dollars (USD $100).

The Company is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, health outcomes, or other intangible losses, arising from Your use of or inability to use the Service.

13. DMCA Notice

If You believe that content on the Service infringes Your copyright, please send a notice to vibedieting@lembo.email with sufficient information to identify the allegedly infringing material.

14. Governing Law

These Terms are governed by the laws of the United States. You agree to submit to the jurisdiction of the applicable courts for resolution of any disputes, except where arbitration applies.

15. Arbitration and Class Action Waiver

Disputes must be resolved through binding individual arbitration. Class actions and representative actions are not permitted. By using the Service, You waive Your right to participate in a class action lawsuit or class-wide arbitration.

16. Severability and Waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full effect. Failure to enforce any right or provision does not constitute a waiver of that right.

17. Changes to These Terms

The Company may update these Terms at any time. Material changes will be announced through reasonable notice, including by email or in-app notification. Continued use of the Service after updates constitutes acceptance of the revised Terms.
